1) Agreement to Terms
By accessing or using Found-Benefits.com, our forms, emails, SMS, or related services (collectively, the “Services”), you agree to these Terms and our Privacy Policy (together, the “Agreement”). If you do not agree, do not use the Services.
2) Who We Are / What We Do (No Government Affiliation)
Found-Benefits.com is a private, independent website that provides information about potential grants, offers, savings, and assistance programs (“Third-Party Offers”). We are not a government agency, lender, insurer, or charity, and we do not determine eligibility or award benefits.
3) No Guarantees or Warranties About Offers
Information about Third-Party Offers may be provided by outside sources and may be incomplete, change without notice, be time-limited, location-limited, or inaccurate. We do not guarantee (and expressly disclaim any promise of) approval, eligibility, availability, timelines, amounts, savings, outcomes, or results. All use is at your own risk.
4) Not Financial/Legal/Tax/Medical Advice
Content is for informational purposes only and does not constitute financial, legal, tax, medical, insurance, or professional advice. You should consult qualified professionals before making decisions.
5) Eligibility & Your Responsibilities
You represent that you are at least 18, provide accurate information, and will comply with applicable laws. You alone are responsible for verifying Third-Party Offer details, requirements, deadlines, and suitability for your circumstances before applying or acting.
6) Accounts; Communications; TCPA/E-Sign
If you create an account, keep credentials confidential; you’re responsible for activities under it.
By submitting your information, you consent to receive communications (e.g., email, phone, SMS) from us and our partners as described in the Privacy Policy. Consent is not a condition of purchase; message/data rates may apply; reply STOP to opt out of SMS. You consent to electronic records/signatures (E-SIGN).
7) Third-Party Partners, Offers, and Links
We may display, link to, or transmit your information to third parties (e.g., benefit providers, financial institutions, insurers, affiliates, data/lead partners). We do not control or endorse third-party content, terms, privacy practices, or decisions, and we are not a party to your transactions with them. 8) Compensation & Lead Distribution Notice
We may be compensated by partners for referrals, clicks, impressions, or sign-ups. By using the Services, you acknowledge we may share, distribute, or resell information you provide to relevant partners to help match or market offers, consistent with our Privacy Policy.
9) User Content & License
If you submit content (e.g., reviews, messages), you grant us a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to use, reproduce, modify, publish, display, and distribute that content in connection with the Services. You represent you have rights to submit it and it does not infringe others’ rights.
10) Acceptable Use
You will not: (a) misuse or interfere with the Services; (b) attempt to reverse engineer, scrape, or harvest data (except as allowed by robots.txt); (c) upload malware; (d) infringe IP or privacy rights; (e) use the Services for unlawful, deceptive, or abusive purposes.
11) Intellectual Property
The Services, including text, graphics, logos, and software, are owned by us or our licensors and protected by law. Except as expressly permitted, you may not copy, distribute, or create derivative works from the Services.
12) DMCA
If you believe content infringes your copyright, send a notice to info@Found-Benefits.com with required details under 17 U.S.C. §512.
13) Changes to the Services or Terms
We may update the Services and these Terms at any time. Updates are effective when posted with the “Last Updated” date. Continued use means you accept the changes.
14) Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES (AND ALL CONTENT, OFFERS, LINKS, AND FEATURES) ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS AND WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED.
We disclaim all warranties, including merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, reliability, availability, or that the Services will be uninterrupted, timely, secure, error-free, or free of viruses. We do not warrant any outcomes, approvals, savings, or eligibility related to Third-Party Offers.
15) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOSS OF PROFITS, REVENUE, GOODWILL, DATA; OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY.
Our total liability for any claim arising out of or relating to the Services or this Agreement will not exceed the greater of $100 or the amount you paid to us (if any) in the 12 months preceding the event giving rise to liability. Some jurisdictions do not allow certain exclusions/limits, so portions may not apply.
16) Indemnification
You agree to defend, indemnify, and hold harmless Found-Benefits.com and its affiliates, officers, directors, employees, and agents from and against any claims, demands, actions, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising from or related to:
(a) your use or misuse of the Services;
(b) your content or data you submit (including its accuracy, legality, and any consent/authorization);
(c) your violation of this Agreement or applicable law (including TCPA, CAN-SPAM, privacy/data laws);
(d) your dealings with third parties and Third-Party Offers; or
(e) alleged infringement or violation of third-party rights by your content or conduct.
17) Arbitration; Class-Action Waiver; Jury Waiver
Binding Arbitration. Any dispute, claim, or controversy arising out of or relating to the Services or this Agreement will be resolved by final and binding arbitration on an individual basis under the rules of AAA, before a single arbitrator, in Delaware, in English. The Federal Arbitration Act governs interpretation and enforcement.
No Class Actions. You and we agree to bring claims only in your or our individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative action.
Exceptions. Either party may bring qualifying claims in small-claims court or seek injunctive relief for IP or unauthorized access.
Opt-Out. You may opt out of arbitration/class waiver by sending written notice to [info@Found-Benefits.com] within 30 days of first accepting these Terms.
18) Governing Law; Venue
This Agreement is governed by the laws of Delaware, without regard to conflicts of laws. Subject to the arbitration clause, courts located in Delaware will have exclusive jurisdiction and venue.
19) Suspension/Termination
We may suspend or terminate access to the Services at any time, with or without notice, for any reason. Upon termination, provisions that by nature should survive (e.g., IP, disclaimers, liability limits, indemnification, arbitration) will survive.
20) International Use
We operate primarily in the United States. We make no representation that the Services are appropriate or available elsewhere. Access from jurisdictions where the Services are illegal is prohibited.
21) Force Majeure
We are not liable for delays or failures due to events beyond our reasonable control (e.g., acts of God, labor disputes, internet failures, outages, laws, disasters).
22) Assignment
We may assign this Agreement without notice. You may not assign or transfer it without our prior written consent.
23) Severability; Waiver; Entire Agreement
If any provision is found unenforceable, the remainder remains in effect. Our failure to enforce any provision is not a waiver. This Agreement (including the Privacy Policy) is the entire agreement between you and us regarding the Services and supersedes prior agreements.
